Illinois Attorney General Files Suit Against Another Alleged Rescuer

Fighting one of the newer schemes in mortgage fraud, Illinois Attorney General Lisa Madigan filed her third lawsuit in as many months against a mortgage “rescue” company and its officers for misleading homeowners to believe they could save their homes when in fact the homeowners were selling their homes to “rescue” company employees who stripped out the substantial equity and left homeowners on the verge of eviction.

In this latest court action, Madigan sued MarTav Services Corporation, an Illinois Corporation; Winter Lake, Limited, an Illinois Corporation; Erika Norton, individually and as President of MarTav Services Corporation and Winter Lake, Limited; Edward D. Johnson, individually and as an agent for MarTav Services Corporation; and Felicia Johnson, individually and as an agent for MarTav Services Corporation.

These companies prey on people who are just trying to save their homes,” Madigan said. “They are like vultures circling people who are down on their luck.

In filing her lawsuit, Madigan noted that MarTav seeks out people who are behind on their mortgage payments or about to lose their homes. For example, MarTav’s ads contain statements such as: “Let MarTav Services Corporation help keep your homeownership dream alive,” and “We have every intention of helping you, we are not here to unlawfully take away your home priviledges [sic].”

In the complaint against MarTav, Madigan detailed one the stories of homeowners who allegedly had been taken in by the company. Madigan said the story is a textbook example of how the mortgage rescuers defraud homeowners.

In one instance, a homeowner fell behind on her mortgage payments after she had to quit her job because she had open heart surgery. The holder of her mortgage filed a foreclosure action against her. After the foreclosure action was filed, the homeowner received a solicitation from MarTav. Edward Johnson and Erika Norton told the homeowner she could pay a monthly rent and at the end of one year she would get her home back. The homeowner did not know she would be selling her home.

The purported purchase price for the homeowner’s home was $145,000. Felicia Johnson obtained a mortgage on the home for $123,250. Part of the purchase money paid off the homeowner’s existing mortgage, which was approximately $79,000, and MarTav paid the homeowner a mere $1,000.

The defendants informed the homeowner that MarTav also paid for the homeowner’s insurance, paid off some money the homeowner owed a lawyer from her divorce, paid the water bill and took some money for fees. She was never informed how much money MarTav took for their fees.

The homeowner made monthly payments to MarTav. However, after she had resumed working, the Internal Revenue Service notified her that one of her paychecks was going to be taken for back taxes. She called Edward Johnson to tell him that she could not make her monthly payment because of the IRS action, but Edward Johnson told her to make her payment. The homeowner, believing she needed to refinance her home to get it back, asked Edward Johnson for a payoff letter. Johnson refused her request. The homeowner then quit making her monthly payments and attempted to negotiate a sales price for her home, but Edward Johnson would not sell it to her for the prior agreed price of $123,250 and would not agree to a price that she could afford. Winter Lake filed a forcible entry and detainer action against the homeowner. Felicia Johnson sold the home to a third party for $165,000. The homeowner was later evicted from her home. Had the homeowner gone through the foreclosure process, she would have at least received the substantial equity she had built up in her home.

Madigan’s lawsuit seeks a permanent injunction against the defendants, full restitution to homeowners, a civil penalty of $50,000 for each violation of the Consumer Fraud Act and a civil penalty of $10,000 per Consumer Fraud Act violation committed against a person 65 or older.

In addition to filing individual suits, Madigan also has proposed legislation in Illinois to prevent rescuers from victimizing others. This legislation, Senate Bill 2349, would provide numerous protections for homeowners by requiring that: (1) rescuers provide homeowners with a written contract that lays out all the terms of the sale and makes it clear that the home is actually being sold; (2) the homeowner has the right to cancel the contract for five business days after it is executed by all parties; (3) prior to sale of the property, the purchaser must make a determination that the homeowner has the ability to make rental payments and buy the house back; (4) and the purchaser must pay the homeowner at least 82 percent of the fair market value of the home if the homeowner is unable to buy back the home.

These protections are critical,” Madigan said. “Our goal is to keep scam artists out of peoples’ lives and keep people in their homes.”

    My husband, Gary R. Blodgett, received a letter from the Office of District Attorney concerning a company ASP. We are totally unaware of this company let alone the withdrawal. I will check our accounts, but presently, I am in charge of everything, as my husband had a stroke about 4yrs ago and is doing quite well but dosen't handle any of the household expenses and does not drive, and has difficulty hearing. Nothing about this even sounds familiar I don't know of any documents from ASP or NHCD. It is Saturday, so it will be Monday before I can talk to the bank. Thankyou for the information.     Dear Govenor, FDLE refuse to even consider our case so we are seeking help from the FBI and the Justic Dept.
    Were facing massive losses due to a family of preadatory lenders out of Tampa Florida headed by Barry Silber and his front man Jim Marks. mortgage broker came to our home responding to a forclosure notice from our first mortgage company promised he could rescue us from forclosure and quickly repair our credit and get us a low cost loan. Eventually the man befriended us, discovered that we had great equity in our big waterfront home & prime family owned properties. Fell behind on our first mortage but only needed a little cash, about 30 - 50 thou was actually needed. Marks assured us that it didn't matter about our income or our credit. he said he couldn't find anyone to make a small loan so he made the huge loan (that we didn't need or want) himself through his own company. Big fees no income lead to a quick default. Now trapped but Marks insisted that he could refinance us again immidiatly at much lower rates but at the same time delivered a forclosure notice destroying credit. During this process he had secured our friendship by coming over bringinhg food, going our on our boat with his family, scuba diving and swimming in our crystal clear river and advising us on how to manage and better profit from our families holdings. We like idiots fell for everything and allowed him to created a corp for our families holdings with him holding 50% from any profits. He handled all the book, money and sales of the properties. After he sold around $300.000.00 to $500.00.00 thousnad dollars of our families assets things got finacially worse for us because he controled everything. We never really understood what he was doing to our families assets because we truly trusted him and then he forced us to sign over other properties to avoid another forclosure, he said it didn't matter because everything was going into the Corp that we owned. But that never happened the property never went into the corp and he has now sold them. All that money went to Jim Marks with the exception of a small amount that he gave us to pay our basic bills. The Scam...In the begining Jim Marks said he had an investor that he wanted to bring to our home to look at our families properties. We didn\'t know it but we were being scamed and set up By Marks and the so called investor. The investor was really a hard money lender and relative of Jim Marks, he was also an attorney named Barry Silber ) He disaperraed for a long time but surfased later, We did not know he was a family member of the broker and an attorney or the main lender on our properties until much later, now we find out that this attorney was in this scam from the very beginning, he was creating complex contracts to strip us of our equity and our assets. In fact it was an entire family who owned the title company the mortgage comapany and real estate company. We never had a chance against these professinals. In the end the attorney created a very complex security agreement that he attached to our home mortgage. it stated that if we defaulted within one year on the new mortgage agreement we would lose all the properties in the corp, all rights to the corp and we would lose our home to him. Of course Jim Marks was always standing with us encorging us to sign the loan docs pretending to provide us with more loans at a moments notice if we got into trouble. Then at some point when we naturally defaulted again Jim Marks said that we should quick claim our home over to him and his relative to avoid another forclosure because he couldn\'e provide any more loans. With all the properties in their hands now, the interest rate may hit the 900 percent mark via the equitable mortage issues. It has also been told to me that they may have committed criminal racketerring and fellony usuary. I am also told that they have Broked all sorts federal laws including TILA, HOPEA, FAIR TRADE, ETC ETC laws. If you have any info on these people please call us. We have reported all of these people to most of the law enforcement agencies both federal and state in the hope that we will eventually find justic. So that everyone knows this fact. Any one of our properties could have cured our financial dificulties but we trusted Jim Marks and his plan very much. But we started to get a little concerned at some point so the family sold a waterfront property the sale was a done and ready to close brining in aroung $300.000.00 Marks con us into stoping the sale and giving the property to him. Long story... but in short the Attorney/ lender / partner who were all family member now ownes and controls our 50% of the corporation and the broker Jim Marks controls the other 50% and now they are forclosing on the only thing we have left, our waterfront home.     Barrera, a certified tax preparer since 1991 and the owner of Barrera Professional
    Services on Beverly Boulevard, Los Angeles since 1993, prepared false federal income
    tax returns from 1994 to 1997, according to his plea agreement with the government. The
    tax returns were false because Barrera fabricated Schedules C (Profit or Loss from A Sole
    Proprietorship) and fictitious dependents to fraudulently claim Earned Income Credits on
    behalf of his clients.
    In addition to the returns prepared for his clients, Barrera also prepared additional false
    income tax returns in his clients' names without the clients' knowledge and retained the
    fraudulently obtained tax refunds for himself. In 1996 alone, he submitted false federal
    tax returns that claimed a total of approximately $443,589.

The land records say they paid me $171,570 for my home on September 19, 2008 (date of Quit Claim) but they have never paid me a single dime. I filed a police report in Overland Park (2008-019126) for sexual assault against Darrin Volk. When he first insisted I come back into my home (I'd been living with my Mom, she drove me to ECT treatments, and I couldn't drive yet.) He paid to turn on all the utilities. When he asked me for sex and I felt like I had to or I'd lose my home. This went on for six months. When I wouldn't answer my door anymore is when this all started. I've never been asked to pay rent. I had 12 months to redeem my home from the Sheriff sale, but Darrin won't give anyone any information to help me find other financing. I have several e-mails from other lenders telling me he would not cooperate. I have a hearing scheduled with Judge Vokin on Thursday at 11:00 am, but yesterday I found about 8 other people who they've done this same thing to, all tried in front of Juge Vokin, had great attorneys (I can't afford one) and they still lost their homes. I'm so scared I don't know where to turn. If I could get someone to issue me a supersedeas bond I would have more time but I've tried for a week and no one will issue me one. The last surety co. said it was because I didn't have an attorney. I've found your name on the office of the state bank commissioner's web site. Can you please call and stop this for me?     Please, won't anyone STOP these fraudulent FORECLOSURE RESCUE scam artists?

    I'm reaching out in every direction. I'm at a loss. Over the past two years I've done all I know how to do, contacted the police, every consumer protection agency, the Johnson County DA's office, the Secretary of State, RESPA, TILA, HUD, and on and on and on. I've done all I know to do to get relief from criminal actions. I'm so tired. These problems, ignored just morph. I am surprised, and sickened, by the lack of feeling or interest or effort from groups specifically created to mitigate these issues before life just becomes too painful. I'm sure I'm doing something wrong. I get too emotional. But what else can be done? I'd be so pissed if I was in a position to offer guidance to someone like me, and I couldn't reach out. Detective Russell has copies of lots of documents, and I can get you anything else you need. I'm sorry to go on, I just want to help you understand how urgent this is. I've attached several documents to help you understand my case. But Detective Russell said I immediately had to find out from you what needs to be done to stop the eviction. I've tried with all my heart to stop it, but I can afford an attorney, and no one will sell me a supersedeas bond. I'm disabled, 45, and only feel safe in my home.
