North Carolina Jury Finds Real Estate Consultant Guilty in Mortgage Fraud Scheme

A federal jury in Greenville, North Carolina convicted James Thomas Davis, 60, Raleigh, North Carolina, of conspiracy, false statements on real estate closing documents, wire fraud, and mail fraud following a four-day trial in federal court before Senior United States District Judge Malcolm J. Howard.

Davis was convicted of a conspiracy and fraud scheme involving newly built houses in Raleigh, Garner, and Wake Forest, North Carolina. Davis purported to be a real estate “consultant” and ran entities called “Easy Financial Service” and “Eagle Investments Club.” Davis and others defrauded mortgage lenders by submitting false and misleading documents, particularly HUD-1 settlement statements, to induce the lenders to make loans to borrowers recruited by Davis. Among the false statements in these documents were inflated sales prices, backed by appraisals, down payments secretly provided by the seller, and hidden cash kickbacks to Davis.

Davis and others also defrauded individuals who were told by Davis that they could “lease-to-own” the houses until their credit was repaired. These victims lost thousands of dollars in down payments and monthly payments they believed would be applied to a house purchase.

The jury found Davis guilty on all six counts against him.

In addition to Davis, a Raleigh based residential house builder, David Layton, 54, was charged in this case. In April, 2006, Layton pled guilty to conspiring with Davis to make and use false documents at closings where Layton was the seller. Layton testified at trial as part of the United States’ case-in-chief. Layton told the jury, among other things, that he and Davis had created fake sales prices based on appraisals rather than a bargain between a real buyer and seller.

Acting United States Attorney George E. B. Holding stated, “the fraudulent real estate deals in this case hurt individuals, neighborhoods, and lenders. We will vigorously prosecute all parties to deceit in such common but important transactions."

Sentencing of Layton is scheduled for September 5, 2006. Sentencing of Davis is scheduled for the week of November 6, 2006. Davis is in custody pending sentencing.

    I'M A VICTIM OF MORTGAGE FRAUD. I HAD A STROKE IN JANUARY 2006, DUE TO TRYING TO SAVE MY HOME. IN 2000, I WENT FOR SETTLEMENT ON A LOAN, I WAS SUPPOSED TO BORROW AGAINSDT MY HOME. WHEN I GOT, TO THE PLACE IN MARYLAND, NO LAWYER WAS PRESENT, AS WAS TOLD IT WOULD BE. NO NOTARY. THE BROKER, I FOUND OUT LATER, HAD NO BROKERS LICENSE FOR 10 YEARS. SINCE, I LIVE IN DELAWARE, THE ATTORNEY, I FOUND OUT LATER, NEVER SHOWED UP, BECAUSE HE HAD NO MARYLAND LICENSE. I WAS TOLD TO SIGN PAPERS, AND THE PAPERSD WOULD BE SENT TO DELAWARE SETTLEMENT LAWYER, AT THIS TIME, I REQUESTED ANOTHER APPOINTMENT, BUT NO THE BROKER PRESSURED ME TO SIGN AND REASSURED ME, THAT THIS WOULD BE FINE. OF COURSE, IT WASN'T I FOUND OUT LATER. AFTER I SIGNED, THE PAPER WORK, I FOUND OUT LATER BY THE STATES ATTORNEYS OFFICE, THAT I HAD SIGNED TWO MORTGAGES, ONE FOR 30 YEAR FIXED, AND ANOTHER FOR 15 YEAR ADJUSTABLE. I ALSO FOUND OUT, THAT THE LOANS WERE PLACED ON ANOTHER PIECE OF PROPERTY, NOT MY HOME.AFTER I SIGNED, THE PAPERS, I WAS REAR ENDED, BY A MAN, HE SAID HURRYING TO A MEETING, TALKING ON HIS CELL PHONE. I RECEIVED SEVERAL INJURIES, AND OF COURSE WHAT A COINCIDENCE. I HAVE FOUGHT THESE LOAN SHARKS, SINCE 2004 IN COURT. THE ATTORNEY, I HIRED OF COURSE NEVER SHOWED UP FOR DEPOSITIONS, NEVER SHOWED WHEN THE JUDGE ORDERED HIM TO COURT, THEN HE FACKED A SICKNESS, SO HE COULDN'T GO TO COURT. IF THIS WASN'T A PAY OFF. I FEEL I HAVE BEEN VICTIMIZED AND I WANT RECOURSE. I HAD A STROKE, IN JANUARY 2006, TRYING TO SAVE MY HOME AFTER LIVING HERE ON MY PROPERTY FOR 42 YEARS. ALSO, WHEN I HAD STROKE, THE LOAN COMPANY WENT TO COURT IN ANOTHER COUNTY, NOT THE COUNTY WHERE I LIVE AND THE JUDGE ORDERED THE LOAN TAKEN OFF THE WRONG PARCEL AND PLACE IT ON MY HOME AND SELL MY HOUSE AT AUCTION. AT THIS GIVEN TIME, I WAS TAKEN TO WILMINGTON, DELAWARE COURT, AND APPLIED FOR A AUTOMATIC STAY, CHAPTER 13, TO SAVE MY HOME. THE APPLICATION WAS STAMPED 9:15 A.M., THE SHERIFF AND THE LOAN COMPANY, DIDN'T STOP THE SALE AS ORDERED, AT 10:00 AM, THEY SOLD MY HOME FOR $30,000.00,BIDDED IN BY THE LOAN COMPANY ALONE, NO ONE WAS BIDDING. MY
    FAMILY AND FRIENDS, NEIGHBORS WERE AT THE SALE FOR MY SUPPORT. MY HOME IS WORTH 675,000.00. I FEEL THAT THIS WAS A FRAUDULENT DEAL. LATER THE LOAN COMPANY AND THE SHERIFF WERE TOLD THAT THIS SALE WASN'T LEGAL, AND THE SHERIFF SHOULD HAVE STOPPED THE SALE. ALSO, THE SHERIFF HAD ALOT OF OTHER LOANS, THAT WERE PLACED AGAINST ME FOR THE SALE AND THEY WERN'T EVEN MINE. I FEEL, I NEED A GOOD REAL ESTATE LAWYER, WHO WILL HELP ME. THE LOAN COMPANY NOW HAS GONE AFTER THE TITLE COMPANY AND THE SETTLEMENT COMPANY FOR A SETTLEMENT. THE LOAN COMPANY STATED THAT I WILL STILL OWE SOMETHING. I FEEL I HAVE SUFFERED ALOT FROM THIS ORDEAL AND WANT RESTITUTION. IS THERE ANYONE WHO WHO IS HONEST ANYMORE? SINCE, I FILED CHAPTER 13, TO SAVE MY HOME, I HAVE RUINED MY CREDIT AND LIFE. AT AGE 60 WHO WILL HELP ME. BEFORE, THE SALE I HAD TWO LOANS APPROVED, BUT THE LOAN COMPANYS LAWYER, WOULDN'T RECOGNIZE THEM. HE WENT ON WITH THE SALE. HOW CROOKED, CAN YOU BE. I FEEL, THAT THIS IS FRAUD AND THESE LOAN COMPANIES PREY ON THE ELDERLY.
